Terms and conditions governing use of the Hire Mountain platform
By accessing or using the Hire Mountain website (www.hiremountain.com) and related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all visitors, users, job candidates, clients, and Mountaineer partners.
Hire Mountain Inc. ("Hire Mountain", "we", "us") operates a managed offshore staffing platform connecting North American businesses with pre-vetted global professionals. Our services include talent sourcing and vetting, behavioral assessment (WorkStyle Compass™), candidate-client matching, managed staffing services, and the Mountaineer sales partnership program.
Certain features of the Platform require registration. When creating an account, you agree to provide accurate, current, and complete information, maintain the security of your login credentials, accept responsibility for all activity under your account, and notify us promptly of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
By submitting an application through the Platform, you represent that all information provided is truthful and accurate, you are legally authorized to work in the relevant jurisdiction, and you consent to background verification as part of the vetting process.
Participation in the WorkStyle Compass™ assessment is voluntary but recommended for matching purposes. The assessment measures behavioral preferences, not intelligence or capability. Results are used alongside other factors in the matching process and are never the sole basis for hiring decisions. See our Privacy Policy for details on how assessment data is handled.
Completing an application or assessment does not guarantee placement. Hire Mountain facilitates connections between candidates and clients but does not guarantee employment. Terms of employment or engagement are established between the candidate and the client, subject to applicable laws.
Client engagements are governed by separate service agreements that detail specific terms including pricing, service levels, managed service deliverables, and payment terms. These Terms of Service supplement but do not replace individual service agreements.
Hire Mountain offers transparent flat-rate monthly pricing across three service tiers. Rates displayed on the Platform are averages and guidelines. Actual rates may be negotiated based on role requirements and experience. Managed service add-ons carry a 25% premium. Complete pricing details are provided during the onboarding process.
Managed service clients receive a 30-day satisfaction guarantee with free replacement if standards are not met, subject to the terms of their service agreement.
The Mountaineer Program is Hire Mountain's performance-based sales partnership. Participation is governed by separate Mountaineer agreements that detail commission structures (2/4/6% tiered model), account attribution rules, referral program terms, and termination provisions. These Terms of Service apply in addition to individual Mountaineer agreements.

To the maximum extent permitted by law, Hire Mountain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or services. Our total liability for any claim shall not exceed the fees paid by you to Hire Mountain in the twelve (12) months preceding the claim. Hire Mountain does not guarantee uninterrupted or error-free operation of the Platform.
You agree to indemnify and hold harmless Hire Mountain, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms, your use of the Platform, any content you submit, or your violation of any applicable law or third-party rights.
Any disputes arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration in Toronto, Ontario, Canada. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will remain in effect.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision does not constitute a waiver. These Terms, together with our Privacy Policy and any applicable service agreements, constitute the entire agreement between you and Hire Mountain regarding the Platform.
